The Ministry of Steel has implemented the Steel and Steel Products (Quality Control) Order) under the BIS Act, 2016. This order is regularly updated to include more types and grades of steel products. According to this rule, all imported steel products must have BIS certification, a valid Mill Test Certificate, and must display the ISI mark along with the BIS license number on the product.

To make the process of seeking clarifications easier, the Ministry has launched a dedicated online platform called the TCQCO Portal. It is now compulsory for all importers to submit clarification requests through this portal for each steel consignment that does not have BIS certification.

Importantly, the Ministry provides clarification on a case-by-case basis, which means a new application must be submitted for every consignment, unless specifically mentioned otherwise in the previous clarification. This helps ensure proper tracking, compliance, and smooth import clearance for steel products entering the Indian market.

NO OBJECTION CERTIFICATE (NOC) FOR STEEL IMPORTERS

A No Objection Certificate (NOC) is needed for steel products that have different specifications and are not covered under the mandatory BIS certification list. If a steel grade or product does not fall under the required BIS standards, the Ministry of Steel can issue a clarification or exemption (NOC) for that specific consignment.

Sometimes, the product code used during import may suggest to customs that BIS certification is required—even when it’s not. Also, customs officers may mistake similar-looking products as being part of the mandatory BIS list, which can lead to unnecessary delays or penalties.

To avoid such issues, importers should apply for a No Objection Certificate (NOC) confirming that the product is not covered under mandatory BIS certification. This NOC is issued by the Ministry of Steel on a per grade, per consignment basis.

EXEMPTION FROM MINISTRY OF STEEL

he Ministry of Steel has formed a Technical Committee to examine and review applications requesting clarification or exemption under the Steel and Steel Products (Quality Control) Order, 2020. This is done to determine whether a specific steel product or grade falls within the scope of mandatory BIS certification.

If the product is not covered, the Ministry may issue a No Objection Certificate (NOC). Please note that NOCs are issued on a per grade, per consignment basis.

Types of Clarification Requests

Importers can submit clarification requests under any of the following three categories:

1. Clarification in Advance – Before placing the order for the material

2. Material in Transit – While the goods are being shipped

3. Material at Port – When the goods have already arrived at the Indian port

If the material is in transit, you also need to submit all related documents for each consignment. These include the invoice, bill of lading, original mill test certificates, insurance copy, and any other important papers.

If the material has reached the port of destination;
you also need to submit the Bill of Entry (if it has been generated), along with all the other required documents.

Your covering letter should clearly mention the details of each consignment, and all documents should be neatly arranged and marked for easy reference.
